Terms of Use

The following terms and conditions (“Terms”) govern your access to and use of and any information, data, text, graphics, photos or other materials uploaded, downloaded or appearing on the Application (collectively referred to as “Content”). Your access to and use of the Application are conditioned on your acceptance of and compliance with these Terms. By accessing or using the Application you agree to be bound by these Terms.

Using the Application

You agree that you will not:

copy, modify, create derivative works from, distribute or publicly display any content that you obtain from the Application without prior written consent; or
interfere or attempt to interfere with the proper working of the Application or any activities conducted on the Application

Disclaimer of Warranties

While reasonable efforts are made to ensure that the contents of this Application are accurate, the Application and its contents are provided on an “as is,” “as available” information-only basis, without warranties of any kind, including any warranty, express or implied, that the Application and its contents are up to date, accurate, relevant, or completeness of the information. Should accurate information or confirmation of completeness be required, please contact the Engineering and IS Department of Halifax Water (customercare@halifaxwater.ca).

Limitation of Liability

You agree that, to the maximum extent permitted by applicable law, Halifax Regional Water Commission, its councillors, officers, directors, employees, agents, representatives, partners, and licensors shall not be liable for any indirect, incidental, special, consequential or punitive damages, whether incurred directly or indirectly, resulting from your access to or use of or inability to access or use the application or any conduct of any third party on or using the application. Halifax Regional Water Commission shall not be held liable for any misuse of this information.

The limitations referenced herein shall apply to any theory of liability, whether based on warranty, contract, statute, tort (including negligence) or otherwise, and whether or not Halifax Regional Water Commission, its councillors, officers, directors, employees, agents, representatives, partners, or licensors have been informed of the possibility of any such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Indemnification

You agree to indemnify and hold harmless Halifax Regional Water Commission, its councillors, officers, directors, employees, agents, representatives, partners and licensors from and against all claims or demands made by any third-party.

Entire Agreement

These Terms represent the entire and exclusive agreement between Halifax Regional Water Commission and you regarding the Application and your use of the Application. If any portion of these Terms is found to be unenforceable, the remaining portion will remain in full force and effect.

Halifax Regional Water Commission may make changes to these Terms from time to time, without notice, at its sole discretion. It is your responsibility to read, understand and accept the Terms each time that you access the Application.
